The liberalisation policies are ushering in faster economic growth. The Law too has seen new developments trying to catch up with economy. In a rapidly changing world of technology, practicing law is a big challenge. The evolution of new statutes and procedures for quick adjudication of disputes are the new norm. The age old adage that wheels of justice turn slowly” is fading.
The Parliament recognising the need for a specialised law has introduced “The Commercial Courts Act, 2015” which is a self-contained legislation, departing from the laws that were hereto before applicable, including making it mandatory for the parties to first attempt Mediation even prior to the commencement of the lis.
Unlike many other professions, a lawyer while being taught different statutes, seldom has access to working discussions on new developments in Law, but when thrust with a legal situation, is expected to be master of the subject. My passion for Mediation Mediation & Procedural Mechanism of trial before Commercial evinced automatic interest in the twin concepts of Pre-Institution Courts. My experience as a Trainer in Mediation helped me in analyzing the practical aspects better and understanding the theories of both concepts, which are mostly similar, though may differ in its applications.
Observing my keen interest and my interaction on the subject with Hon’ble Judges, lawyers & friends, several of them encouraged me to share my thoughts and hence, this effort. I am thankful to them. The features of this book are separately listed.
I immensely thank Hon’ble Justice SHRI ABHAY SHREENIWAS OKA, Judge, Hon’ble Supreme Court of India, (As Hon’ble Chief Justice High Court of Karnataka) for finding time to read my book, suggesting valuable inputs and pen his foreword.
